OUR COMMITMENT TO PRIVACY
Crowdpac LLC knows that you care about how your personal information is used and shared, and we take your privacy seriously. Accordingly, we have adopted a written information security program. We understand that you may have questions or concerns regarding how your personal information that you provide to Crowdpac will be used and secured by Crowdpac. To make this Privacy Policy and our written information security program easy to find, we make them available on the home page of the Crowdpac website at Crowdpac.com (the "website") and, for our Privacy Policy, also through our mobile applications. You may also email us at info@Crowdpac.com with any privacy-related questions you have.
Please note that any user of the Crowdpac Platform may request that all of the Personal Information we collected from such user be deleted by submitting such request to info@crowdpac.com. We then will delete all associated user data except for information that we are required by applicable law, including the rules and regulations of the Federal Election Commission, to maintain.
Capitalized terms used in this Privacy Policy but not otherwise defined in this Privacy Policy have the meanings given to them in our User Agreement. Our User Agreement is available on our website.
APPLICABILITY OF PRIVACY POLICY
This Privacy Policy applies to all information we collect through our web applications from Crowdpac users, including you. When you are no longer a Crowdpac user, we will continue to share your information as described in this policy. This policy only applies to your use of Crowdpac and does not apply to either the practices or services of any payment processing service used by you through Crowdpac’s web applications or the privacy or security practices of Senders, which may differ from those set forth in this Privacy Policy. Please check with individual Senders about the policies they have in place..
Throughout this policy, we use the term "Personal Information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider Personal Information to include information that has been aggregated and/or anonymized so that it does not identify a specific user. Crowdpac will own such aggregated and anonymized information.
THE INFORMATION WE COLLECT FROM ALL USERS
When you visit the Crowdpac website, we collect your IP address, and standard web log information, such as your browser type and the pages you accessed in our website. We also may collect certain geo-location information. If you do not agree to our collection of this information, you should not use the Crowdpac Platform. If you desire that all of the Personal Information we collected from you be deleted, please submit such request to info@crowdpac.com. We then will delete all associated user data except for information that we are required by applicable law, including the rules and regulations of the Federal Election Commission, to maintain.
When you register as a Crowdpac user, we collect the following information from you:
- Account Information - text-enabled cellular/wireless telephone number, machine or mobile device ID and other similar information, and your username and password.
- Identification Information - your full name, mailing address, email address, and date of birth. If you desire to make a political contribution or pledge using the Crowdpac Platform, we also will require you to give us your occupation, the name of your employer, and your Social Security Number. Crowdpac will comply with the requirements of the US Social Security Administration with respect to the secure storage of your Social Security Number. For a Registered Campaign, we collect such identification information about the authorized officer associated with such campaign (usually its Treasurer) and the Federal Election Commission Identification Number assigned to such campaign. For a Registered National Party Committee, we collect such identification information about the chairperson or treasurer of such national party committee and the Federal Election Commission Identification Number assigned to such committee. For a PAC, we collect such identification information about the authorized officer associated with such committee (usually its Treasurer) and the Federal Election Commission Identification Number assigned to such PAC.
- Device Information - information about you: (a) from your mobile device such as your device type, machine or mobile device identification number, media access control address, geo-location, time zone, language setting, browser type, and IP address, and (b) from third parties for purposes of transaction processing, identity verification, fraud detection or prevention and other similar purposes.
- Social Web Information - including but not limited to your email account information.
- Other information - we may collect additional information from you not specifically described here that we request and that you permit us to collect.
Before permitting you to use or to continue using Crowdpac, we may require additional information from you that we can use to verify your identity or other information or to manage risk and compliance throughout our relationship. We may also obtain information about you from third parties such as identity verification, fraud prevention and similar services.
When you are using Crowdpac, we collect information about your Crowdpac activity, including your contribution, pledge and messaging history and your interests in political and social causes. We also may collect information about your mobile device, computer or other access device for fraud prevention and other similar purposes.
When you make a contribution using Crowdpac, your designated preferred funding source (either your bank account and routing number or your debit and credit card) will be shared with Crowdpac’s payment processing services provider. Crowdpac, however, will not have full visibility of such information and will not store such financial information. We will collect information about your contribution and pledge amounts and the recipients of your contributions and pledges and will assign you a rating based on your contribution and pledge history.
Finally, we may collect additional information from or about you in other ways not specifically described here. For example, we may collect information related to your contacts with us.
THE INFORMATION WE COLLECT FROM SENDERS
For purposes of this section, "you" and "your" refer to Senders.
A. Information We Collect
The Personal Information we collect from Senders of email messages to their Recipient lists broadly falls into the following categories:
- Information you provide to us: You (or your organization) may provide certain Personal Information to us when you register with Crowdpac and use the Crowdpac Platform, consult with our customer service team, send us an email, integrate the Crowdpac Platform with another website or service, or communicate with us in any other way.
- Business contact information (such as your name, job title, organization, location, phone number, email address, and country);
- Marketing information (such as your preferences);
- Account log-in credentials (such as your email address or username and password when you sign up for an account with us); and
- Troubleshooting and support data (which is data you provide or we otherwise collect in connection with support queries we receive from you. This may include contact or authentication data, the content of your chats and other communications with us, and the product or service you are using related to your help inquiry).
- Information we collect automatically: When you use the Crowdpac Platform, we may automatically collect or receive certain information about your device and usage of the Crowdpac Platform (collectively “Crowdpac Platform Usage Data”). In some (but not all) states, this information is considered Personal Information under applicable data protection laws. We use cookies and other tracking technologies to collect some of this information. For further information, please review the section below and our Cookie Policy at www.Crowdpac.com/cookie-policy.
- Device information: We collect information about the device and applications you use to access the Crowdpac Platform, such as your IP address, your operating system, your browser ID, and other information about your system and connection.
- Log data: Our web servers keep log files that record data each time a device accesses those servers and the nature of each access, including originating IP addresses and your activity on the Crowdpac Platform (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take (for example, which features you used)), device event information (such as system activity, error reports (sometimes called ‘crash dumps’)), and hardware settings. We may also access metadata and other information associated with files that you upload to the Crowdpac Platform.
- Usage data: We collect usage data about you whenever you use with the Crowdpac Platform, which may include the dates and times you access the Crowdpac Platform and your browsing activities. We also collect information regarding the performance of the Crowdpac Platform, including metrics related to the deliverability of emails and other communications you send through the Crowdpac Platform. This information allows us to improve the content and operation of the Crowdpac Platform and facilitates research and analysis of the Crowdpac Platform.
- Information we collect from other sources: From time to time, we may obtain information about you from third-party sources, such as public databases, social media platforms, third-party data providers, and our joint marketing partners. Examples of the information we receive from other sources include demographic information (such as age and gender), device information (such as IP addresses), location (such as city and state), and online behavioral data (such as information about your use of social media websites, page view information and search results and links). We use this information, alone or in combination with other Personal Information we collect, to enhance our ability to provide relevant marketing and content to you and to develop and provide you with more relevant products, features, and services.

B. Use of Personal Information
We may use the Personal Information we collect or receive through the Crowdpac Platform (alone or in combination with other data we source) for the purposes and on the legal bases identified below:
- In accordance with our legitimate interests to operate and administer the Crowdpac Platform.
- To send you system alert messages in reliance on our legitimate interests in administering the Crowdpac Platform and providing certain features. For example, we may inform you about temporary or permanent changes to the Crowdpac Platform, such as planned outages, or send you account, security or compliance notifications, such as new features, version updates, releases, abuse warnings, and changes to this Privacy Policy.
- To communicate with you about your account and provide customer support to perform our commitments to you for the use of the Crowdpac Platform or in reliance on our legitimate interests in administering and supporting the Crowdpac Platform.
- To enforce compliance with our User Agreement and applicable law, and to protect the rights and safety of our Users in reliance on our legitimate interest to protect against misuse or abuse of the Crowdpac Platform and to pursue remedies available. This may include developing tools and algorithms that help us prevent violations. For example, sometimes we review the content that Senders send or display to ensure it complies with our User Agreement. To improve that process, we have software that helps us find content that may violate our User Agreement. We may or our third-party service provider may also review content that Senders send or display. This benefits all Senders who comply with our User Agreement because it reduces abuse and helps us maintain a reliable platform. Please do not use the Crowdpac Platform to send or display confidential information.
- To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.
- To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements in reliance on our legitimate interests.
- To prosecute and defend a court, arbitration, or similar legal proceeding.
- To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
- To provide, support and improve the Crowdpac Platform to perform our commitments to you for the use of the Crowdpac Platform or in reliance on our legitimate interests in administering and improving the Crowdpac Platform and providing certain features. For example, this may include sharing your information with third parties in order to provide and support the Crowdpac Platform or to make certain features of the Crowdpac Platform available to you. When we share your Personal Information with third parties, we take steps to protect your information in a manner that is consistent with our obligations under applicable privacy laws. For further information about how we share your information, please see the below section entitled, How We Protect and Share Personal Information.
- To provide suggestions to you and to provide tailored features within the Crowdpac Platform that optimize and personalize your experience in reliance on our legitimate interests in administering the Crowdpac Platform and providing certain features. This includes adding features that compare Senders’ email campaigns, using data to suggest other publishers your Recipients may be interested in, or using data to recommend products or services that you may be interested in or that may be relevant to you or your Recipients. Some of these suggestions are generated through analysis of the data used in our data analytics projects, as described below.
- To perform data analytics projects in reliance on our legitimate business interests in improving and enhancing the Crowdpac Platform for our Users. Our data analytics projects use data from Crowdpac accounts, including Personal Information of Recipients, to provide and improve the Crowdpac Platform. We use information like your sending habits and your Recipients’ contribution history, so we can make more informed predictions, decisions, and products for our Users. For example, we use data from Crowdpac accounts to enable product recommendation, audience segmentation, and predicted demographics features for our Users. If you or your Recipients prefer not to have their data used for this purpose, you can alter the settings on your account (as described here) to opt out of data analytics projects, or your Recipients can opt out of data analytics projects at any time by emailing us at info@Crowdpac.com. As always, we take the privacy of Personal Information seriously, and will continue to implement appropriate safeguards to protect this Personal Information from misuse or unauthorized disclosure.
- To personalize the Crowdpac Platform, content and advertisements we serve to you in reliance on our legitimate interests in supporting our marketing activities and providing certain features within the Crowdpac Platform. We may use your Personal Information to serve you specifically, such as to deliver marketing information, product recommendations and non-transactional communications (e.g., email notifications) about us, in accordance with your marketing preferences and this Privacy Policy.
In order to send an email to your contacts or use certain features in your account, you need to upload to the Crowdpac Platform a list of Recipients (a Distribution List) and all associated information related to those Recipients, such as their names and email addresses. We use and process this information to provide the Crowdpac Platform in accordance with our User Agreement and this Privacy Policy.
A Distribution List can be created in a number of ways, including by importing Recipients, such as through a CSV or directly from your email client. We do not, under any circumstances, sell your Distribution Lists. If someone on your Distribution List complains or contacts us, we might then contact that person.
If we detect abusive or illegal behavior related to your Distribution List, we may share your Distribution List or portions of it with affected ISPs or anti-spam organizations to the extent permitted or required by applicable law.
If a Recipient chooses to use the Forward to a Friend (FTF) link in a Sender Email, it will allow the Recipient to share the Sender’s email content with individuals not on the Sender’s Distribution List. When a Recipient forwards an email to a friend, we do not store the Recipient’s email address or their friend’s email address, and no one is added to any Distribution List as a result of the FTF link. The Sender who created the email campaign only sees an aggregate number of times their Sender Emails were forwarded by a Recipient and does not have access to the email addresses used to share or receive that forwarded content.
THE INFORMATION WE COLLECT FROM RECIPIENTS
This section applies to the information we process as a data controller about Recipients who receive and/or reply to Senders Emails. When the Crowdpac Platform is used by Senders, much of the Personal Information we collect and process about Recipients through the Crowdpac Platform is obtained by us as a processor on behalf of the Senders. Crowdpac is not responsible for the privacy or security practices of the Senders, which may differ from those set forth in this Privacy Policy. Please check with individual Senders about the policies they have in place. For purposes of this section, "you" and "your" refer to Recipients.
A. Information We Collect
The Personal Information that we may collect or receive about you broadly falls into the following categories:
- Information we receive about Recipients from Senders: A Sender may provide Personal Information about you to us through the Crowdpac Platform. When a Sender uploads their Distribution List or integrates the Crowdpac Platform with another website or Crowdpac Platform (for example, when a Sender chooses to connect their ecommerce account with Crowdpac), or when you sign up with a Sender to be include in its Distribution List, the Sender may provide us with certain Personal Information about you such as your name, email address, address, or telephone number. You may have the opportunity to update some of this information by electing to update or manage your preferences via an email you receive from a Sender.
- Information we collect automatically: When you interact with an email that you receive from a Sender, we may collect information about your device and interaction with an email. We use cookies and other tracking technologies to collect some of this information. Our use of cookies and other tracking technologies is discussed more below and in more detail in our Cookie Policy which may be found at www.Crowdpac.com/cookie-policy.
- Device information: We collect information about the device and applications you use to access emails sent through the Crowdpac Platform, such as your IP address, your operating system, your browser ID, and other information about your system and connection.
- Usage data: It is important for us to ensure the security and reliability of the Crowdpac Platform. Therefore, we also collect usage data about your interactions with Sender Emails transmitted using the Crowdpac Platform, which may include dates and times you access Sender Emails) and your browsing activities (such as what pages are viewed and which emails are opened). This information also allows us to ensure compliance with our User Agreement and Code of Conduct, to monitor and prevent Crowdpac Platform abuse, and to ensure we attain certain usage standards and metrics in relation to the Crowdpac Platform. We also collect information regarding the performance of the Crowdpac Platform, including metrics related to the deliverability of emails and other electronic communications that our Senders send through the Crowdpac Platform. This information allows us to improve the content and operation of the Crowdpac Platform and facilitate research and perform analysis into the use and performance of the Crowdpac Platform.
- Information we collect from other sources: From time to time, we may obtain information about you from third-party sources, such as social media platforms, and third-party data providers.
B. Use of Personal Information
We may use the Personal Information we collect or receive about you in reliance on our (and where applicable, our Senders’) legitimate interests for the following purposes:
- To enforce compliance with our User Agreement and applicable law. This may include utilizing usage data and developing tools and algorithms that help us prevent violations.
- To protect the rights and safety of Senders, third parties, or Crowdpac. For example, sometimes we review the content of our Senders’ Emails to make sure they comply with our User Agreement. To improve that process, we have software that helps us find email campaigns that may violate our User Agreement. We, or our third party service provider, may review those particular email campaigns, which may include your Personal Information. This reduces the amount of spam being sent through our servers and helps us maintain high deliverability.
- To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.
- To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.

- To perform data analytics projects. Our data analytics projects use data from Crowdpac accounts, including your Personal Information, to provide and improve the Crowdpac Platform. We use information, like your contribution history, provided to us by Senders, so we can make more informed predictions, decisions, and products for Senders. For example, we use data from Crowdpac accounts to enable product recommendation, audience segmentation, and predicted demographics features for Senders. If you prefer your data not to be used in this manner, you can opt out of data analytics projects at any time by completing this form or emailing us at info@Crowdpac.com.
- To carry out other business purposes. To carry out other legitimate business purposes, as well as other lawful purposes about which we will notify you.
Depending on the country in which you reside, you may have the following data protection rights:
- To access; correct; update; port; delete; restrict or object to our processing of your Personal Information.
- You also have the right to complain to a data protection authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority.
As described above, for much of the Personal Information we collect and process about Recipients through the Crowdpac Platform, we act as a processor on behalf of Senders. In such cases, if you are a Recipient and want to exercise any data protection rights that may be available to you under applicable law or have questions or concerns about how your Personal Information is handled by Crowdpac as a processor on behalf of an individual Sender, you should contact the relevant Sender that is using the Crowdpac Platform, and refer to their separate privacy policies.
If you no longer want to be contacted by one of the Senders through the Crowdpac Platform, please unsubscribe directly from that Sender’s newsletter or contact the Sender directly to update or delete your data. If you contact us directly, we may either forward your request to the relevant Sender or provide you with the identity of the Sender to enable you to contact them directly.
We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may ask you to verify your identity in order to help us respond efficiently to your request.
INFORMATION FROM CHILDREN
We do not knowingly solicit or collect information from any individuals under the age of 13. If we become aware that we have unknowingly collected Personal Information from a child under the age of 13, such information will be deleted from our system.
HOW WE USE COOKIES
We and our third-party partners may use various technologies to automatically collect and store certain device and usage information (as discussed above) when you visit our website or use the Crowdpac Platform or when Recipients interact with a Sender’s Email, and this may include using cookies and similar tracking technologies, such as pixels and web beacons (collectively, "Cookies"). We use Cookies to recognize you as a Crowdpac user; customize Crowdpac for your use, customize other content and contribution opportunities for you; measure the effectiveness of our profiling of Crowdpac users; perform a wide range of analytics; mitigate risk and prevent potential fraud; and to promote trust and safety across our sites and the Crowdpac Platform.
We also insert a bit of code known as a "web beacon” in the Sender Emails transmitted to Recipients using the Crowdpac Platform, which enable us to track certain behavior, such as whether the email was delivered and opened and whether links within the email were clicked. Web beacons allow us to collect information such as a Recipient’s IP address, browser, email client type, and other similar data as further described above. We use this information to measure the performance of Senders’ Emails, and to provide analytics information and enhance the effectiveness of the Crowdpac Platform, and for the other purposes described above. Our web beacons do not collect personally identifiable information. Users wishing to disable our web beacons should do so by turning images "off" in their email client (e.g., Outlook, Outlook Express). Please see your email client for more information.

Certain aspects and features of the Crowdpac Platform and our website are only available through the use of Cookies, so if you choose to disable or decline Cookies, your use of the Crowdpac Platform may be limited or not possible.
We, or a data provider we have engaged, also may place or recognize a unique cookie on your browser to enable you to receive customized ads, content or services. No personally identifiable information is placed into these cookies. The cookies may reflect de-identified demographic or other data linked to data you voluntarily have submitted to us, e.g., your email address, in hashed, non-human readable form. To opt-out of these cookies or learn more please go to http://www.networkadvertising.org/managing/opt_out.asp.
Do Not Track: Do Not Track ("DNT") is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not track users unless they enable the “remember me” feature on the Crowdpac signup page, in which case we store their email/username using browser cookies. If you set DNT, then you will be unable to utilize the “remember me” feature for future log-ins to Crowdpac.
HOW WE PROTECT AND STORE PERSONAL INFORMATION
We store and process your personal information using third party servers located in data centers in the United States. We also use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our office and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities. We comply with the requirements of the US Social Security Administration with respect to the secure storage of your Social Security Number.
We strive to ensure security on our systems. Despite our efforts, we cannot guarantee that personal information will not be accessed, disclosed, altered or destroyed by breach of our administrative, managerial and technical safeguards. Therefore, we urge you to take adequate precautions to protect your personal data as well, including never sharing your Crowdpac password with anyone.
If Crowdpac learns of a systems security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Crowdpac Platform, you agree that Crowdpac may communicate with you electronically. Crowdpac may post a notice on its website if a security breach occurs. We may also send an email to you at the email address you have provided to us. You consent to receiving notices by email. You agree to provide Crowdpac up-to-date contact information, including email address. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice of a security breach), please email us at info@Crowdpac.com.
HOW WE USE THE PERSONAL INFORMATION WE COLLECT
We may use your personal information to:
- provide the Crowdpac Platform and support your requests;
- process your contributions and pledges, and monitor and send notices to you about your contributions and pledges on the Crowdpac Platform;
- resolve disputes, collect fees, and troubleshoot problems;
- prevent potentially fraudulent, prohibited or illegal activities, and enforce our User Agreement;
- create an account connection between you and our third-party payment processing service provider;
- customize, personalize, measure, and improve the Crowdpac Platform and the content and layout of our website;
- send you updates about political news and political candidates, campaigns and other organizations;
- compare information for accuracy and verify it with third parties;
- perform other duties as required by law; and
- perform analytics using aggregated and anonymized information based on information provided by you.
HOW WE SHARE PERSONAL INFORMATION WITHIN THE CROWDPAC PLATFORM
To process contributions and pledges made using the Crowdpac Platform, we need to share some of your personal information with the payment processing service linked to the Crowdpac Platform, your bank or credit card issuer with your consent and at your direction to do so, including if you authorize an account connection with your bank or credit card issuer, and the Authorized Recipient to which you are contributing or pledging. Your contact information, date of sign-up, date of birth, occupation, employer, the number of contributions and pledges you have made and other rating and verification metrics may be provided to the Authorized Recipient.
We work with Registered Campaigns, Registered National Party Committees, PACs and L&S Campaigns to enable them to accept contributions and pledges from you using Crowdpac. We confirm to that Authorized Recipient that you are a Crowdpac user and that the Authorized Recipient should accept your contribution or pledge via the Crowdpac Platform.
We do not access or store your credit card number or bank account number and therefore cannot disclose it to anyone. That information will be provided to our third-party payment processing Crowdpac Platform enabled via Crowdpac and it will be safeguarded in accordance with their privacy policies.
HOW WE SHARE PERSONAL INFORMATION WITH OTHER PARTIES
We may share and disclose your Personal Information to the following types of third parties for the purposes described in this Privacy Policy (for purposes of this section, "you" and "your" refer to Senders, Recipients, and other Users unless otherwise indicated):
- Our service providers: Sometimes, we share your information with our third party service providers working on our behalf for the purposes described in this Privacy Policy. For example, companies we’ve hired to help us provide and support the Crowdpac Platform or assist in protecting and securing our systems and services and other business-related functions. Other examples include identity verification, fraud prevention, payment processing, website and database hosting and administration, business support services, internet services, information technology services and content delivery services.
- Advertising partners: We may partner with third-party advertising networks, exchanges, and social media platforms (like Facebook) to display advertising on the Senders Emails or to manage and serve our advertising on other sites, and we may share Personal Information of Senders and other Users with them for this purpose. We and our third-party partners may use Cookies and other similar tracking technologies, such as pixels and web beacons, to gather information about your activities on the Crowdpac Platform and other sites in order to provide you with targeted advertising based on your browsing activities and interests. - Any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (a) as a matter of applicable law or regulation, (b) to exercise, establish, or defend our legal rights, or (c) to protect your vital interests or those of any other person.
- A potential buyer (and its agents and advisors) in the case of a sale, merger, consolidation, liquidation, reorganization, or acquisition. In that event, any acquirer will be subject to our obligations under this Privacy Policy, including your rights to access and choice. We will notify you of the change either by sending you an email or posting a notice on the Crowdpac website.
- Any other person with your consent.
