JURISDICTION AND VENUE
- This Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1331, as the lawsuit arises under federal law, including violations of privacy protections and potential constitutional violations.
- Venue is proper in this Court under 28 U.S.C. § 1391 because the events giving rise to these claims occurred within the jurisdiction of this Court, and the Defendants reside or conduct business in this district.
FACTUAL ALLEGATIONS
- Privacy Invasion and Data Harvesting: The Defendants, through their various companies and business practices, have engaged in extensive data collection, analysis, and surveillance on private citizens, including the Plaintiff. This includes, but is not limited to, tracking online activity, personal preferences, spending habits, communications, and even location data through platforms such as Facebook, PayPal, Twitter, Truth Social, Rumble, Neuralink, Starlink, Palantir Technologies, and others. These companies have collected vast quantities of sensitive data without consent, often for commercial, political, or surveillance purposes. Defendants have become exceedingly wealthy through the exploitation of personal information from millions of users, yet they have failed to fairly compensate those whose data they have used, as no permission was ever granted for such use or profit.
- Palantir Technologies' Involvement in Surveillance: Palantir, co-founded by Peter Thiel, has developed tools like Palantir Foundry and Palantir Gotham, which are used by government agencies and corporations for large-scale data analysis. These tools have been employed to collect and process vast amounts of personal data, often without informed consent, and have been involved in national security and intelligence operations, raising significant privacy concerns.
- Elon Musk's Companies and Data Collection: Elon Musk's companies, including SpaceX, Twitter, Rumble, Neuralink, and Starlink, have massive data collection capabilities. Twitter, as a social media platform, tracks the communications, behaviors, and preferences of its users, while Neuralink may be gathering sensitive neurological data from participants. Starlink collects internet activity data from users who rely on its satellite internet services.
- Violation of Privacy Rights: The Defendants' actions infringe upon the Fourth Amendment of the U.S. Constitution, which protects citizens against unreasonable searches and seizures. Furthermore, these practices violate federal laws such as the Electronic Communications Privacy Act (ECPA) and Stored Communications Act (SCA), as well as various state-level privacy protections.
CLAIMS FOR RELIEF
Count I: Violation of the Right to Privacy (Fourth Amendment) Plaintiff alleges that Defendants have unlawfully infringed upon Plaintiff’s constitutional right to privacy by engaging in widespread and unlawful surveillance activities through their various platforms and technologies. These actions violate the Fourth Amendment’s protection against unreasonable searches and seizures.
Count II: Violation of the Electronic Communications Privacy Act (ECPA) Plaintiff claims that Defendants’ surveillance practices, including the collection of electronic communications data, violate the Electronic Communications Privacy Act (18 U.S.C. § 2510 et seq.), which protects individuals from unauthorized interception of their electronic communications.
Count III: Violation of the Stored Communications Act (SCA) Plaintiff claims that Defendants violated the Stored Communications Act (18 U.S.C. § 2701 et seq.) by accessing, using, and disclosing Plaintiff’s personal communications stored on various platforms (e.g., Facebook, PayPal, Twitter, etc.) without consent or legal authorization.
Count IV: Invasion of Privacy – Intrusion upon Seclusion Plaintiff alleges that Defendants’ data collection and surveillance activities constitute an unlawful intrusion upon Plaintiff’s seclusion and solitude, which is a recognized privacy tort under state law.
PRAYER FOR RELIEF
WHEREFORE, Plaintiff respectfully requests that the Court:
- Order Defendants to cease and desist all unlawful surveillance activities and data harvesting practices.
- Award Plaintiff's damages of $500,000 a person for the violation of their privacy rights, including actual and punitive damages, as provided under federal and state laws.
- Grant Plaintiff any equitable relief necessary to protect their privacy rights, including injunctive relief against further data misuse.
- Award Plaintiff reasonable attorneys' fees and costs associated with bringing this lawsuit.
- Grant such other relief as the Court deems just and proper.
