Peter Thiel, Elon Musk, Donald Trump, JD Vance, Mark Zuckerberg, Palantir Technologies, SpaceX, Twitter, Rumble, Neuralink, Starlink, Truth Social, PayPal, Facebook, Palantir Technologies, Founders Fund, Clarium Capital, Valar Ventures, Theranos, Big Ideas Ventures, Heritage Foundation, The Seasteading Institute, and Related Entities, Defendants Case No. COMPLAINT Plaintiff, hereby files this civil lawsuit against Peter Thiel, Elon Musk, Donald Trump, JD Vance, Mark Zuckerberg, Palantir Technologies, SpaceX, Twitter, Rumble, Neuralink, Starlink, Truth Social, PayPal, Facebook, Founders Fund, Clarium Capital, Valar Ventures, Theranos, Big Ideas Ventures, The Seasteading Institute, Heritage Foundation and other related entities (collectively referred to as "Defendants") for violations of privacy rights, unauthorized surveillance, and misuse of personal data, pursuant to the following allegations: PARTIES

1. Plaintiff the Citizens of the United States of America, and is the individual bringing this lawsuit to protect their privacy rights and those of others similarly situated.
2. Defendant Peter Thiel is a private individual and a major shareholder in Palantir Technologies, PayPal, Facebook, Founders Fund, and several other related companies.
3. Defendant Elon Musk is the founder of SpaceX, Tesla, Neuralink, and Starlink, and has been involved in a range of ventures, including Twitter, Rumble, and Truth Social.
4. Defendant Donald Trump is the founder and promoter of Truth Social and has significant political influence in the United States.
5. Defendant JD Vance is a politician who owns Rumble, worked for Thiel, and has worked closely with Defendants in Silicon Valley and media platforms to influence public opinion.
6. Defendant Mark Zuckerberg is the CEO of Facebook (Meta Platforms), which collects massive amounts of personal data from its users.
7. Defendant Palantir Technologies is a private company , specializing in big data analytics and working closely with government agencies.
8. Defendant SpaceX is a private aerospace manufacturer and space transport services company founded by Elon Musk.
9. Defendant Twitter is a social media company, previously owned by Elon Musk, that has access to vast amounts of data on its users.
10. Defendant Rumble is an online video platform associated with various Silicon Valley investors, including Peter Thiel and JD Vance.
11. Defendant Neuralink is a neurotechnology company co-founded by Elon Musk that may engage in the collection of sensitive neurological data.
12. Defendant Starlink is a satellite internet company, also owned by Elon Musk, which may collect data on users' internet activities.
13. Defendant Truth Social is a social media company associated with Donald Trump, which collects and analyzes personal data from its users.
14. Defendant PayPal is an online payment company co-founded by Peter Thiel, which tracks financial transactions and behaviors.
15. Defendant Facebook is a social media company, also known as Meta Platforms, Inc., that collects large amounts of personal data from its users, with ties to Peter Thiel as an early investor.
16. Defendant Founders Fund is a venture capital firm co-founded by Peter Thiel, with investments in companies that collect and use personal data.
17. Defendant Clarium Capital is a hedge fund founded by Peter Thiel, with investments in data-driven industries.
18. Defendant Valar Ventures is a global venture capital firm co-founded by Peter Thiel that focuses on early-stage investments.
19. Defendant Theranos is a health technology company where Peter Thiel was an early investor, and is now defunct but had a history of controversial data practices.
20. Defendant Big Ideas Ventures is a venture capital fund focusing on clean technologies and innovations that involve data collection.
21. Defendant The Seasteading Institute is a think tank supported by Peter Thiel that promotes creating independent floating nations and may have surveillance implications.
22. Defendant Heritage Foundation is a Koch Organization that sponsored Project 2025.

JURISDICTION AND VENUE

1. This Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1331, as the lawsuit arises under federal law, including violations of privacy protections and potential constitutional violations.
2. Venue is proper in this Court under 28 U.S.C. § 1391 because the events giving rise to these claims occurred within the jurisdiction of this Court, and the Defendants reside or conduct business in this district.

FACTUAL ALLEGATIONS

1. Privacy Invasion and Data Harvesting: The Defendants, through their various companies and business practices, have engaged in extensive data collection, analysis, and surveillance on private citizens, including the Plaintiff. This includes, but is not limited to, tracking online activity, personal preferences, spending habits, communications, and even location data through platforms such as Facebook, PayPal, Twitter, Truth Social, Rumble, Neuralink, Starlink, Palantir Technologies, and others. These companies have collected vast quantities of sensitive data without consent, often for commercial, political, or surveillance purposes. Defendants have become exceedingly wealthy through the exploitation of personal information from millions of users, yet they have failed to fairly compensate those whose data they have used, as no permission was ever granted for such use or profit.
2. Palantir Technologies' Involvement in Surveillance: Palantir, co-founded by Peter Thiel, has developed tools like Palantir Foundry and Palantir Gotham, which are used by government agencies and corporations for large-scale data analysis. These tools have been employed to collect and process vast amounts of personal data, often without informed consent, and have been involved in national security and intelligence operations, raising significant privacy concerns.
3. Elon Musk's Companies and Data Collection: Elon Musk's companies, including SpaceX, Twitter, Rumble, Neuralink, and Starlink, have massive data collection capabilities. Twitter, as a social media platform, tracks the communications, behaviors, and preferences of its users, while Neuralink may be gathering sensitive neurological data from participants. Starlink collects internet activity data from users who rely on its satellite internet services.
4. Violation of Privacy Rights: The Defendants' actions infringe upon the Fourth Amendment of the U.S. Constitution, which protects citizens against unreasonable searches and seizures. Furthermore, these practices violate federal laws such as the Electronic Communications Privacy Act (ECPA) and Stored Communications Act (SCA), as well as various state-level privacy protections.

CLAIMS FOR RELIEF Count I: Violation of the Right to Privacy (Fourth Amendment) Plaintiff alleges that Defendants have unlawfully infringed upon Plaintiff’s constitutional right to privacy by engaging in widespread and unlawful surveillance activities through their various platforms and technologies. These actions violate the Fourth Amendment’s protection against unreasonable searches and seizures. Count II: Violation of the Electronic Communications Privacy Act (ECPA) Plaintiff claims that Defendants’ surveillance practices, including the collection of electronic communications data, violate the Electronic Communications Privacy Act (18 U.S.C. § 2510 et seq.), which protects individuals from unauthorized interception of their electronic communications. Count III: Violation of the Stored Communications Act (SCA) Plaintiff claims that Defendants violated the Stored Communications Act (18 U.S.C. § 2701 et seq.) by accessing, using, and disclosing Plaintiff’s personal communications stored on various platforms (e.g., Facebook, PayPal, Twitter, etc.) without consent or legal authorization. Count IV: Invasion of Privacy – Intrusion upon Seclusion Plaintiff alleges that Defendants’ data collection and surveillance activities constitute an unlawful intrusion upon Plaintiff’s seclusion and solitude, which is a recognized privacy tort under state law. PRAYER FOR RELIEF WHEREFORE, Plaintiff respectfully requests that the Court:

1. Order Defendants to cease and desist all unlawful surveillance activities and data harvesting practices.
2. Award Plaintiff's damages of $500,000 a person for the violation of their privacy rights, including actual and punitive damages, as provided under federal and state laws.
3. Grant Plaintiff any equitable relief necessary to protect their privacy rights, including injunctive relief against further data misuse.
4. Award Plaintiff reasonable attorneys' fees and costs associated with bringing this lawsuit.
5. Grant such other relief as the Court deems just and proper.
